188A Business Innovation

Criteria

1) Department of Home Affairs visa criteria for the Business Innovation and Investment (Provisional) visa (subclass 188) – Business Innovation stream.

2) Age: You must be aged less than 55 years at the time of application.

3) Business turnover: If you are seeking to migrate to Sydney  for at least two of the four fiscal years immediately before the application is made, you must have had a qualifying ownership interest1 in up to 2 main businesses that had an annual turnover of at least A$1.0 million. If you are seeking to migrate to Regional NSW2  for at least two of the four fiscal years immediately before the application is made, you must have had a qualifying ownership interest in up to two main businesses that had an annual turnover of at least at least A$500,000 (in line with Department of Home Affairs criteria).

4) Net personal and business assets: If your proposed business will be in Sydney  you (or you and your spouse combined) must have net personal and business assets of at least A$1.3 million. If your proposed business will be in Regional NSW  you (or you and your spouse combined) must have net personal and business assets of at least at least A$800,000 (in line with Department of Home Affairs criteria).

5) Successful business career: You must provide a full resume of your business career and responsibilities demonstrating a successful business career.

6) Proposed business activity overview: You must describe the business you intend to establish in NSW. The overview should provide sufficient details for us to understand what your proposed business will be, including details on why you have chosen to establish a business in NSW and the product/service you will provide. See 4.3 on the 188A application form for more details.

7) Business investment: If your proposed business will be in Sydney  your business commitment must include at least A$500,000 in business investment. If your proposed business will be in Regional NSW3  your business commitment must include at least A$300,000 in business investment. The business investment must be in property, plant & equipment, inventory, or purchased goodwill. This definition applies to businesses that will be in Sydney and Regional NSW.

8) Availability of Funds: You must provide evidence of the availability of funds for settling and living expenses for not less than one year.

办理须知：
1、出生证、结婚证、学历、工作经历、无犯罪证明、曾用名等都需要公证。
2、所有材料都需要彩色复印件，如在线申请，需要彩色扫描件。
3、由中国机构颁发的证书须在中国公证处做中英文对照公证；由澳洲机构颁发的证书须持证书原件和复印件，在澳洲当地找太平绅士在复印件上签字。

申请周期：12周，NSW宣布简化188A审理流程，2016年3月1日起生效。

申请费用：
 - 境外申请：820澳币。
 - 境内申请：902澳币。
 - 网上支付：Visa或MasterCard信用卡付款，提交签证申请时请提供付款收据。

188A签证NSW新南威尔士州担保申请条件：

1、满足DIBP对于188A商业创新临时签证的要求，提供书面证据。

2、年龄：55周岁以下。

3、国内公司营业额：
 - 投资NSW悉尼：过去4年中至少2年营业额至少100万澳币，最多2家公司相加。
 - 投资NSW悉尼以外地区：过去4年中至少2年营业额至少50万澳币，最多2家公司相加（DIBP要求）。

4、个人及商业净资产：
 - 投资NSW悉尼：夫妻名下个人及商业净资产至少130万澳元。 
 - 投资NSW悉尼以外地区：夫妻名下个人及商业净资产至少80万澳元（DIBP要求）。

5、成功的经商生涯：提供完整的能够证明成功经商生涯的简历和工作职责。

 6、商业计划概述：
 需要提供充足的在NSW建立生意的细节，包括在NSW建立生意的原因，以及你的公司产品或者服务，300-500字左右。

7、商业投资：在生意中的投资必须用于购买不动产、设备设施、知识产权、存货、商誉。 
 - 投资NSW悉尼：至少投资50万澳币。
 - 投资NSW悉尼以外地区：至少投资30万澳币。
备注：
 NSW取消了对小生意投资类型的限制，188A签证获得者如果想改变生意计划，不需要征得州政府的同意，只需要通知州政府即可。

8、安居资金：提供一年以上的安居资金。
备注：
如果申请人之前被DIBP拒绝或取消过商业签证申请，通常无法获得NSW新南威尔士的邀请。

188A签证NSW新南威尔士州担保材料清单：

1、申请人信息：
 - 护照。
 - 出生公证/身份证。
 - 能证明EOI分数的证明材料。

2、资产证明：
 - 银行对账单。
 - 股票凭证。
 - 财产名称及价值。
 - 贷款对账单。
 - 财务报表/报告。 
 - 验资报告。
 - 其他能证明资产的材料。

3、商业背景
 - 简历/商业生涯陈述/商业经历。
 - 组织结构图，体现你在当前公司的职位。

4、所有权证明：
 - 验资报告。
 - 特殊计划报告。
 - 所有权证明文件。
 - 公司注册信息或执照。
 - 财务报表/纳税证明。
 - 契约协议。
 - 其他体现所有权的材料。

5、公司营业额：
 - 损益表。
 - 资产负债表。
 - 利润表。
 - 公司注册信息或执照。
 - 特殊计划报告。
 - 其他体现公司营业额的材料。

材料说明： 
 1、所有材料必须为certified copies或公证，如果在线申请需要提供公证件的彩色扫描件。
 2、不要邮寄原件，申请材料不回寄。 
 3、非英文材料必须由认证的翻译机构翻译。

188A签证NSW新南威尔士州担保申请流程：

步骤1：通过DIBP SkillSelect提交EOI申请，记下EOI号码。

步骤2：填写NSW188A州担保申请表，准备申请材料。

步骤3：在线支付申请费。

步骤4：提交申请表和材料至NSW新南威尔士，提交方式有：
